The Anne T. Kent California Room of the Marin County Free Library is committed to providing access to Marin County history via its Digital Archive, as a public service and to further scholarship on the subject. Some materials in our archive may be protected by the U.S. Copyright Law (Title 17, U.S.C.). Information about U.S. Copyright is available from the Copyright Office. Furthermore, the reproduction of some of these materials may be restricted by the California Room’s gift or purchase agreements, donor restrictions, privacy and publicity rights, licensing, servicemarks and trademarks.

Written permission from the owner(s) of intellectual property rights is required in order to reproduce or use protected items. Images from the California Room collection cannot be reproduced for commercial purposes or used to promote products or services without appropriate licensing or permission from the intellectual property owner. The Marin County Free Library cannot make any representations regarding the status of copyright or other intellectual property interests in items within our Digital Archive. Intellectual property law is evolving at a swift pace, and persons seeking to utilize items from the Digital Archive are strongly advised to seek out competent legal counsel familiar with intellectual property issues.

It is very difficult, if not impossible, to determine copyright restrictions for materials which form part of an historical archive. The California Room can provide persons interested in facts relevant to analyzing their right to use individual photos with additional acquisition information. Users are strongly encouraged to inform themselves of the acquisition history of the documents they desire to use.

Because we form part of a publicly supported library, we generally do not own the intellectual property rights to the materials in our historical archive. We do not grant permission to display, publish or distribute these materials. It is the patron's obligation to determine the existence of copyrights and/or other use restrictions regarding items within the Digital Archive before displaying, publishing or distributing materials found therein. Full responsibility for determining appropriate use of one of our images resides with the patron.

Notice of Designated Agent for Claims of Infringement

A notification of claimed infringement must be a written communication provided to the agent referenced above that includes:

  1. A physical or electronic signature of the work’s owner or authorized agent holding the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to be which is to be disabled, and the information reasonably sufficient to permit the library to locate the material.
  4. Information reasonably sufficient to permit the service provider to contact the complaining party such as an address, telephone number, and an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copuright owner, its agent or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
